NEW DELHI – The Insurance Regulatory and Development Authority of India Tuesday said it has repealed the guidelines on repatriation of dividends by insurance intermediaries with majority foreign shareholding. Following the repeal, effective Jul. 30, there is no longer a need to seek the regulator's prior approval to repatriate dividends or waive the condition on related party payments, the regulator said. The guidelines were issued on Jan. 3, 2020.
The guidelines had prescribed certain conditions to be satisfied by a foreign-owned intermediary, including prior approval from IRDAI to repatriate dividends and the imposition of a cap on related-party payments. The latter condition stipulated that no payment to any related party of the foreign owner could exceed 10% of the total expenses of the foreign-owned intermediary in any financial year, with disclosure to the regulator being mandatory.
