KOLKATA – After the Food Safety and Standards Authority of India initiated three adjudication cases against Nestle India Ltd. over alleged non-compliance involving NAN Excella Pro Stage 1 and Lactogen Pro 1 infant nutrition products, the company said Friday that its products are fully compliant with all applicable regulations.
"The said products (that is, NAN Excella Pro Stage 1 and Lactogen Pro 1) and their labels were approved by the expert committee of FSSAI," a Nestle India spokesperson said. "In response to the notice, we have again submitted our detailed response to the authorities regarding statements appearing on the label, which are factual in nature and supported by scientific literature."
Earlier, FSSAI said it had examined the products in question, as well as the promotional material available for the two products on e-commerce platforms. For NAN Excella Pro Stage 1, the food safety and standards regulator flagged Nestle's claims relating to five HMOs, which are laboratory-made complex sugars, and whey protein. In the case of Lactogen Pro 1, FSSAI noted the company's claim that whey protein is easy to digest. Accordingly, it sought clarifications from Nestle India.
FSSAI claimed that both products were in contravention of its rules and regulations.
"We confirm to adherence of all regulations, including all norms and label declarations as per applicable laws. We will continue to work closely and support FSSAI in its efforts towards consumer awareness," the Nestle India spokesperson said.
FSSAI had also said that a sample of the follow-up formula manufactured by Nestle India was found sub-standard with respect to biotin content during a laboratory analysis. The sample was subsequently referred for a second analysis, and the referral laboratory also found it to be non-conforming with respect to the prescribed biotin requirement under Indian regulations.
Nestle India shares fell immediately after the FSSAI statement but later recovered. After hitting an intra-day low of INR 1,332.80 on the National Stock Exchange, its shares recovered and finally closed at INR 1,372.40, up 0.1% from the previous close. End
