KOLKATA – The Food Safety and Standards Authority of India Friday initiated three adjudication cases against Nestle India Ltd., alleging non-compliance with its regulations and involving the company's NAN Excella Pro Stage 1 and Lactogen Pro 1 infant nutrition brands.

In a statement, FSSAI said it examined the products and their promotional material available on e-commerce platforms. For NAN Excella Pro Stage 1, the food safety and standards regulator flagged Nestle's claims relating to 5 HMOs and whey protein. In case of Lactogen Pro 1, it took note of the company's claim of whey protein being easy to digest. Accordingly, it sought clarifications from Nestle India.

In the baby and infant food industry, HMO refers to human milk oligosaccharides, which are complex sugars naturally found in breast milk. In infant formula, producers add laboratory synthesised versions of these sugars to mimic the immune-boosting and gut-supporting benefits of real breast milk.

FSSAI said both the products were found to be in contravention of Regulation 4(2) of the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020. This provision restricts promotional claims and material intended to increase the saleability of infant foods. The regulator also cited Section 3 of the Infant Milk Substitutes, Feeding Bottles and Infant Foods (Regulation of Production, Supply and Distribution) Act, 1992, which prohibits their advertisement and promotion.

FSSAI said a sample of the follow-up formula manufactured by Nestle India was found sub-standard with respect to biotin content during a laboratory analysis. This sample was subsequently referred for analysis again and the referral laboratory also found the sample to be non-conforming with respect to the prescribed biotin requirement as per regulations in India.

Shares of Nestle India fell following the FSSAI statement. At 1333 IST, the stock was down over 2% at INR 1,341.00 on the National Stock Exchange.  End
