HC asks SpiceJet to give assets' list on lessor's plea for $8 mln award pay

NEW DELHI – The Delhi High Court Tuesday asked SpiceJet Ltd. to give an affidavit in a sealed cover in three weeks stating list of its assets on lessor Sunbird France 02 SAS's plea, seeking enforcement of a High Court of Justice Business and Property Courts of England and Wales Commercial Court's $8 million award. In March, the English court had asked SpiceJet to pay the money which were dues of rentals and maintenance for leasing three aircraft engines from Sunbird France. The high court will hear the lessor's plea next on Jul. 29.
The high court's order was passed on Sunbird France's prayer to seek interim relief with a direction to SpiceJet to give the list of assets. Sunbird France said that SpiceJet was on the verge of insolvency as there are around 16 insolvency petitions pending against the airline and the Delhi bench of the National Company Law Tribunal had even made a special bench for hearing these pleas against SpiceJet.
In an earlier hearing, the lessor said that despite not paying dues to Sunbird and other lessors, the airline has paid advance salary to its Chairman Ajay Singh. "The chairperson, Mr. Singh, is paid $3.4 million in advance by way of salary for five years in September 2025, when monies are owed to the world at large," said the lessor.
The case has its genesis from Sunbird France leasing three aircraft engines to SpiceJet in 2019. SpiceJet's obligation was to pay rent, maintenance accruals and any other amount, and that obligation was said to be absolute and unconditional, irrespective of any contingency whatsoever, according to the lease agreement between the parties. After non-payment of the rent and the maintenance accruals for the engines, Sunbird France moved the England court seeking a summary judgment. Asking Spicejet to pay, the England court in March said that the airline had no real prospect of successfully defending the rent and maintenance accruals claims, or interest thereon.
Tuesday, the shares of SpiceJet Ltd. ended 2.8% lower at INR 12.86 on the BSE.
