Sunjay Kapur's mother gets HC notice on perjury charges in family trust case

NEW DELHI – The Delhi High Court Wednesday issued a notice to Rani Kapur, mother of late businessman Sunjay Kapur, on allegations of perjury by her daughter-in-law Priya Kapur in a case regarding the RK Family Trust, which holds stake in Sona BLW Precision Forgings Ltd. The high court also sought Rani Kapur's reply on Priya Kapur's application seeking to dismiss the former's suit at the threshold as she had grossly abused the process of court, constituted a fraud upon the court by concealing and suppressing materials, facts and documents and, knowingly made false statements. It will hear the case next on Mar. 23.
The high court was hearing Rani Kapur's suit that sought that RK Family Trust be scrapped and all assets and benefits in the trust be given to her. Rani Kapur said that Sunjay and Priya had fraudulently diverted the former's entire family legacy, estate, and all her movable and immovable assets originally inherited by her to the RK Family Trust.
On Wednesday, Priya Kapur argued that Rani Kapur's suit was an abuse of the judicial process and was founded on incorrect and contradictory claims, particularly the assertion that Rani Kapur was unaware of the RK Family Trust for several years and never knowingly executed any trust-related documents. These claims were contradicted by contemporaneous documents and conduct, Priya Kapur said. The photographs, which are stills from the videographic evidence submitted, of Rani Kapur along with Sunjay Kapur sitting together and signing over the affidavit in presence of the notary of the RK Family Trust show that Rani Kapur knew very well about the existence of the trust way back since 2017, said Priya Kapur.
In 2015, Rani Kapur's husband Surinder Kapur passed away and left his entire estate, including all shares of various companies under Sona Group and his other movable and immovable properties, exclusively to Rani Kapur by means of a will in 2013. According to Rani Kapur, she was the sole beneficiary and legatee of the entire estate of her husband, who was the promoter of various businesses, including the Sona Group of companies.
Rani Kapur said that by means of a complex web of illegal transactions undertaken by Priya Kapur and others in an unfortunate collusion with Sunjay Kapur, all her assets were now vested in one fraudulent trust titled RK Family Trust, without her knowledge. The entire fraud perpetrated upon her had been discovered only now, post the demise of her son, who passed away under mysterious circumstances in June last year, Rani Kapur said.
Sunjay Kapur, chairman of auto parts company Sona BLW Precision Forgings, died unexpectedly in the UK while playing polo, with initial reports citing cardiac arrest as the cause. His death triggered a bitter power struggle within the Kapur family over control and inheritance of the Sona Group empire. Kapur's father was a pioneer of India's auto components industry and had founded the group.
At 1331 IST, shares of Sona BLW Precision Forgings Ltd. were up 1.1% at INR 536.80 on the National Stock Exchange.
