HC notice to Priya Kapur on plea seeking bar on money withdrawal from trust

NEW DELHI – The Delhi High Court Tuesday issued notices to Priya Kapur, wife of the late businessman Sunjay Kapur, and others on his mother Rani Kapur's application seeking a bar on respondents from taking out money from RK Family Trust, which holds stake in Sona BLW Precision Forgings Ltd. In the application, Rani Kapur had also sought that the RK Family Trust be scrapped and all assets and benefits in the trust should be given to her. Rani Kapur said that Sunjay and Priya had fraudulently diverted the petitioner's entire family legacy, estate, and all her movable and immovable assets originally inherited by her to the RK Family Trust.
The court also sought Rani Kapur's reply on Priya Kapur's application seeking rejection of the suit filed by the former. The court will next hear the case on Mar. 23.
In addition, the court asked the involved parties to think about the possibility of settling the disputes amicably through mediation. "There is a lot of dirty linen being washed. It is a sorry state of affairs. All the parties are in pain and all of them have suffered great losses," said the court. God has blessed the parties with financial wealth, everyone should lead a good life, it added. The court said the lawyers can sit together and resolve the tussle for everyone's benefit. "We all know that there are half truths and half false," said the court.
Ultimately, the money is the fruit of someone else's labour, that is Rani Kapur's husband, the late Surinder Kapur, the court told Priya Kapur. It was Surinder Kapur who founded everything and it was his empire, said the court.
The petitioner has sought a permanent injunction against Priya Kapur and others from utilising or acting in furtherance of the RK Family Trust in any manner whatsoever. Rani Kapur sought rendition of accounts of the RK Family Trust, from its inception, among other relief.
In 2015, the petitioner's husband Surinder Kapur passed away and left his entire estate, including all shares of various companies under Sona Group and his other movable and immovable properties, exclusively to Rani Kapur by means of a will in 2013. According to the petition, Rani Kapur was the sole beneficiary and legatee of the entire estate of her husband, who was the promoter of various businesses, including the Sona Group of companies.
The petitioner said by means of a complex web of illegal transactions undertaken by Priya Kapur and others in an unfortunate collusion with Sunjay Kapur, all her assets were now vested in one fraudulent trust titled RK Family Trust, without her knowledge. The entire fraud perpetrated upon her has been discovered only now, post the demise of her son, who passed away under mysterious circumstances in June last year, Rani Kapur said.
Sunjay Kapur, chairman of auto parts company Sona BLW Precision Forgings, died unexpectedly in the UK while playing polo, with initial reports citing cardiac arrest as the cause. His death triggered a bitter power struggle within the Kapur family over control and inheritance of the Sona Group empire. Kapur's father was a pioneer of India's auto components industry and had founded the group.
The high court is also hearing a plea by the children of Sunjay Kapur's former wife Karisma Kapoor, Samaira Kapur and Kiaan Raj Kapur, who sought a share in their father's assets, which are estimated at INR 300 billion. Karisma Kapoor's children had requested the court to pass a preliminary decree for partition in their favour, saying they were entitled to a fifth of their father's estate. The children's plea came after knowing that the entire personal assets of their father were bequeathed to Priya Kapur.
At 1205 IST, shares of Sona BLW Precision Forgings were up 1.0% at INR 535.95 on the National Stock Exchange.
