HC stays proceedings on customs dept's show cause notice to Amber Ent

NEW DELHI – The Gujarat High Court has stayed proceedings on a show cause notice issued by the customs department to Amber Enterprises Ltd. until the next hearing, in a case regarding forms submitted by the company to claim preferential duty benefits, the company said in an exchange filing.

 

The court said the show cause notice did not comply with the prescribed verification procedures mandated under the applicable statutory framework, including the Customs (Administration of Rules of Origin under Trade Agreements) Rules, 2020, as the requisite verification of preferential duty claims had not been undertaken prior to the notice issuance. 

 

In March 2025, the customs department had issued a show cause notice to Amber Enterprises seeking the latter to explain the correctness of the forms submitted in support of preferential duty benefits availed by the company on certain imports made between March 2020 and December 2023. Amber Enterprises had availed certain duty benefits on imports of raw material from the Association of Southeast Asian Nation region. 

 

The customs department had challenged the eligibility of these products for claiming duty benefit. Consequently, Amber Enterprises moved the high court against the customs department's show cause notice.

 

For the September quarter, Amber Enterprises had reported a consolidated net loss of INR 328.57 million on a revenue of INR 16.47 billion. Wednesday, shares of the company ended 4.1% lower at INR 5,784.00 on the National Stock Exchange.  End
