Sunjay Kapur's mother seeks scrapping of trust that holds stake in Sona BLW

NEW DELHI – Late businessman Sunjay Kapur's mother Rani Kapur Wednesday moved the Delhi High Court, seeking that the RK Family Trust, which holds stake in Sona BLW Precision Forgings Ltd., be scrapped and all assets and benefits in the trust be given to her. Rani Kapur said that Sunjay Kapur and his third wife Priya Kapur had fraudulently diverted the petitioner's entire family legacy, estate, and all her movable and immovable assets originally inherited by her to the RK Family Trust.
The petitioner has sought a permanent injunction against Priya Kapur and others from utilising or acting in furtherance of the RK Family Trust in any manner whatsoever. She has sought rendition of accounts of the RK Family Trust, from its inception, among other relief.
In 2015, the petitioner's husband, late Surinder Kapur, passed away and left his entire estate, including all the shares of various companies under Sona Group and other movable and immovable properties belonging to him exclusively to Rani Kapur by means of a will in 2013. According to the petition, Rani Kapur was the sole beneficiary and legatee of the entire estate of her husband, who was the promoter of various businesses, including the Sona Group of companies.
The petitioner said that by means of a complex web of illegal transactions undertaken by Priya Kapur and others in an unfortunate collusion with Sunjay Kapur, all her assets now vested in one fraudulent trust titled RK Family Trust, without her knowledge. The entire fraud perpetrated upon her has been discovered only now, post the demise of her son, who also passed away under mysterious circumstances in June, Rani Kapur said.
In June, Sunjay Kapur, chairman of auto parts company Sona BLW Precision Forgings, died unexpectedly in the UK while playing polo, with initial reports citing cardiac arrest as the cause. His death triggered a bitter power struggle within the Kapur family over control and inheritance of the Sona Group empire. Kapur's father was a pioneer of India's auto components industry and had founded the group.
The high court is also hearing a plea by Sunjay Kapur's second wife Karisma Kapoor's children Samaira Kapur and Kiaan Raj Kapur, seeking a share in their father's assets, which are estimated at INR 300 billion. Karisma Kapoor's children had requested the court to pass a preliminary decree for partition in their favour, saying they were entitled to a fifth of their father's estate. The children's plea came after knowing that the entire personal assets of their father were bequeathed to Priya Kapur.
At 1253 IST, shares of Sona BLW Precision Forgings Ltd. were unchanged at INR 445.75 on the National Stock Exchange. End
