NEW DELHI – The Securities and Exchange Board of India Friday notified easier regulations for foreign portfolio investors investing under its Single Window Automatic & Generalised Access for Trusted Foreign Investors, or SWAGAT-FI, programme. The new provisions come into effect from Jun. 1. The regulator had announced the single window access in December.
Government or government-related investors, highly regulated public retail funds, and appropriately regulated insurance companies and pension funds are eligible for registration as FPIs under the SWAGAT-FI programme. Depositories must allow these investors to maintain all securities, whether as an FPI or as foreign venture capital investors, in a unified manner. Investors using the window are allowed to have over 50% of their corpus consist of investments from non-resident Indians, overseas citizens of India, and resident Indians, SEBI said.
These FPIs can apply to their Designated Depository Participants if they meet the requirements as a SWAGAT-FI and continue their registrations with those participants for 10 years. The periodicity of Know Your Customer review by custodians of such investors will also be 10 years, the regulator said in its amendments to master directions for FPIs, designated depository participants, and eligible foreign investors.
