SC issues notice to 2 airports operated by Adani Ent's SPVs in tariff case

NEW DELHI – The Supreme Court Friday issued notices to airports in Lucknow and Mangaluru, operated by

special purpose vehicles of Adani Enterprises Ltd., the Federation of Indian Airlines, the Airports Authority of India, and the International Air Transport Association, on a plea by the Airports Economic Regulatory Authority of India against the Telecom Disputes Settlement and Appellate Tribunal order rejecting the regulator's aeronautical tariff determination for the two airports. The apex court will hear the case on Feb. 2.

 

In September, the appellate tribunal had set aside the airports regulator's determination of tariffs for Lucknow International Airport Ltd., Mangaluru International Airport Ltd. and four other airports. The appellate tribunal had failed to appreciate that the tariff determination process undertaken by the regulator was an elaborate, specialised regulatory exercise, involving a series of complex, technical, and consultative steps, the regulator said. Such a highly technical exercise can only be undertaken by an expert statutory regulator, the regulator said.

 

The appellate tribunal's order will have a direct and adverse effect on the public interest, as it permits the airports to secure higher tariffs and earn unjustified profits at the expense of airport users, the regulator said. By disregarding the detailed submissions and regulatory determinations of the authority, the appellate tribunal's order effectively places the private interest of the airport operator over the statutory mandate of the authority and the broader public interest, undermining the objectives of fair, reasonable, and transparent tariff regulation under the Airports Economic Regulatory Authority of India Act, 2008, the regulator said.

 

Friday, Adani Enterprises' shares ended 0.2% higher at INR 2,157.30 on the National Stock Exchange.  End
