NCLT admits Tetra-Pak India's insolvency plea against Manpasand Beverages

NEW DELHI – The Ahmedabad bench of the National Company Law Tribunal has admitted Tetra-Pak India Pvt. Ltd.'s plea to start insolvency proceedings against Manpasand Beverages Ltd. for unpaid dues of INR 253.47 million. The tribunal appointed Darshan Bharatbhai Patel as the interim resolution professional of Manpasand Beverages to carry out the functions as per the Insolvency and Bankruptcy Code, 2016.
Manpasand Beverages is known for its fruit-based drinks, particularly the popular Mango Sip, along with brands like Fruits Up and Manpasand ORS. It is headquartered in Vadodara, Gujarat, and targets the mass market, including railways and rural areas.
Manpasand Beverages had entered into two arrangements with Tetra-Pak India, namely standard packaging material supply agreement and equipment sale agreement. However, Manpasand Beverages started defaulting in payments of the invoices under both the agreements April 2018 onwards.
Thereafter, Tetra-Pak India issued demand notices to Manpasand Beverages in 2019, calling upon the latter to make payment of the principal outstanding payable, excluding the interest. These notices were replied to by Manpasand Beverages intimating about a goods and services tax search and seizure proceedings, however, it did not dispute the debt owed and requested time and cooperation for settling accounts, said Tetra-Pak India. After it did not receive its dues, Tetra-Pak India moved the tribunal to start insolvency proceedings against Manpasand Beverages. End
