NEW DELHI – The Delhi High Court Wednesday asked Sun Pharma Laboratories Ltd. to give samples of its semaglutide tablets to Novo Nordisk A/S for the latter to test whether it was infringing the former's patent. The high court was hearing an application by Sun Pharmaceutical Industries Ltd.'s subsidiary Sun Pharma Laboratories seeking to manufacture and market semaglutide tablets, used to treat type 2 diabetes and manage chronic weight loss.

 

Sun Pharma Laboratories said that it was willing to manufacture the semaglutide tablets which were outside the range of the quantity of SNAC, a chemical absorption enhancer, contained in Novo Nordisk's patent on semaglutide. The high court issued a notice to Novo Nordisk on Sun Pharma Laboratories' application and gave the former time to test the tablets. "We don't know what you (Sun Pharma Laboratories) are doing, they (Novo Nordisk) are entitled to check what you are doing," said the court, listing the case for hearing on Nov. 4.

 

 

Novo Nordisk had originally moved the high court alleging that Sun Pharma Laboratories had received approval from the subject expert committee for semaglutide tablets in 3 milligram, 7 milligram and 14 milligram, which violates its patent for semaglutide. In the last hearing in August, the high court had asked Sun Pharma Laboratories to take prior approval of the court before launching semaglutide tablets in the market.  

 

Wednesday, Novo Nordisk said that Sun Pharma Laboratories cannot be trusted. Earlier, Sun Pharma Laboratories had said they were very far away from launching the drug, however, within three weeks, the company has now filed this application. Sun Pharma Laboratories had earlier not disclosed that they had filed an application in February for commercial manufacture of semaglutide tablets. "This does not invoke too much confidence," observed the high court. 

 

At 1218 IST, shares of Sun Pharmaceutical Industries were unchanged at INR 1,929.00 on the National Stock Exchange.  End
