--HC to Sun Pharma arm: Seek court nod before launching semaglutide tablet 

--CONTEXT: HC order on Novo Nordisk plea vs Sun Pharma arm on semaglutide

 

NEW DELHI – Hearing Novo Nordisk A/S's plea, the Delhi High Court Tuesday asked Sun Pharma Laboratories Ltd. to take prior approval of the court before launching semaglutide tablets in the market. If and when a licence is granted for manufacture of semaglutide tablets, before taking any further steps, Sun Pharma Laboratories has to take prior approval of the court through an application for launching these tablets in the market, Justice Anup Jairam Bhambhani said.

 

The high court asked Sun Pharmaceutical Industries Ltd.'s subsidiary Sun Pharma Laboratories to file a response to Novo Nordisk's plea. Novo Nordisk had said that Sun Pharma Laboratories had received approval from the subject expert committee for semaglutide tablets in 3 milligram, 7 milligram and 14 milligram, which violates its patent for semaglutide.  

 

Novo Nordisk said that the moment Sun Pharma Laboratories gets marketing approval, it would launch semaglutide tablets in the market. It said its current patent relates to a tablet and this was a new patent; the previous one related to semaglutide that was injectable.

 

Sun Pharma Laboratories said that the Delhi High Court did not have territorial jurisdiction to hear the case. The respondent said that it was based in Maharashtra. Further, the company still has to go to the licensing authority for approval, Sun Pharma Laboratories said. Contesting the respondent's argument, Novo Nordisk said Sun Pharma Laboratories was also working with the address of Delhi, and carrying out business in the Union territory. Sun Pharma Laboratories sells its products both online and offline in Delhi, and will sell semaglutide tablets in Delhi soon.

 

Sun Pharma Laboratories said that Novo Nordisk must show the similarity in both products, which they have not shown. Novo Nordisk had a patent earlier, which expired, and Sun Pharma Laboratories' product was compared against an expired patent.  

 

On Tuesday, shares of Sun Pharmaceutical Industries Ltd. ended 0.1% lower at INR 1,942.00 on the National Stock Exchange.  End
