NEW DELHI – The Delhi government Thursday said it has decided not to take any adverse legal action against those who were protesting against the National Eligibility cum Entrance Test paper leak, and that arrests already made in this connection will be reviewed and release expedited. The protection, however, will not be extended to persons with criminal antecedents, an official release by the Delhi government's Home Department said.

 

As per the release, by 1800 IST Wednesday, a total of 13 cases were registered by the Delhi Police in connection with the protest relating to the alleged irregularities in the National Eligibility cum Entrance Test. "The Government of National Capital Territory of Delhi has, after careful consideration of all aspects to the circumstances, decided that no adverse legal action will be taken by any of the police authorities within NCT of Delhi against those persons who have been involved in these protests," according to the release.

 

This came after the Supreme Court, while hearing a petition against the police crackdown on protesters at Jantar Mantar, observed Tuesday that peaceful protests are a lawful right and police excesses against demonstrators cannot be justified. Also, the central government had promised the Cockroach Janta Party, which led the protests, that it would not take coercive action against student protesters, before the social media group withdrew the agitation Saturday.

 

"With regard to arrests/detentions already made, in these cases, the process for reviewing the arrests and releasing the arrested persons will be undertaken expeditiously," the Delhi government said in the note, dated Jul. 30 and signed by Principal Secretary (Home) Santosh D. Vaidya. It added that the government "does not propose" to take any further adverse action against individuals involved in the protest, and the matter "shall be treated as closed without any future proceedings on this account". The proposal has been approved by Delhi's lieutenant governor.

 

Delhi being a Union territory with a legislature and the national capital, the city police reports to the Union home ministry through the lieutenant governor and not to the chief minister.  End
