--Zee Ent moves HC alleging infringing content by Blink Commerce on Instagram 

--HC seeks Blink Commerce's reply on Zee Ent's plea, to hear case on Aug 14

 

NEW DELHI –  The High Court of Delhi has issued a notice to Blink Commerce Pvt. Ltd. on a plea by Zee Entertainment Enterprises Ltd., alleging that infringing content has been created and uploaded by the former on its Instagram account. Zee Entertainment has sought that the court restrain Blink Commerce, which operates quick-commerce platform Blinkit, from posting infringing content on the social media platform.  

 

Justice Jyoti Singh permitted Zee Entertainment to place on record the pen drive consisting of screen recordings of the infringing works as created and uploaded by Blink Commerce on its Instagram account. Justice Singh also allowed Zee Entertainment to place additional documents necessary to the case within 30 days. 

 

Zee Entertainment had sought that the court exempt the parties from going to mediation at this stage. Allowing Zee Entertainment's request and noting rulings from the Supreme Court, the high court said the exemption is granted to the petitioner from pre-institution mediation as an urgent relief of injunction is sought by the party. The high court will hear Zee Entertainment's plea against Blink Commerce, which is owned by Eternal Ltd., on Aug. 14. 

 

This is not the first time Zee Entertainment has approached the high court seeking an injunction against the opposite party for copying its content. In May, Zee Entertainment had filed a music copyright infringement suit against JioStar India Pvt. Ltd. Zee Entertainment had sought $3 million in damages, alleging unauthorised use and exploitation of works from its music division on the Reliance-Disney streaming platform, JioStar India, and on some of its television channels. 

 

Zee Entertainment had also filed a suit in the high court against FSN E-Commerce Ventures Ltd., which operated Nykaa, for allegedly using its copyrighted songs in Instagram reels to promote its products, seeking $210,000 in damages. Recently, Zee Entertainment sought that the high court direct Meta Platforms Inc. to take down infringing content from its social media platforms which originally belonged to the media company.

 

At 1157 IST, shares of Zee Entertainment Enterprises Ltd. were at INR 107.62 on the National Stock Exchange, slightly lower than on Wednesday. Shares of Eternal Ltd. were at INR 308.25, over 1% down.  End
