Govt moots integrated digital IBC platform to reduce manual intervention

NEW DELHI – The Ministry of Corporate Affairs Monday proposed an integrated digital platform for the insolvency ecosystem that will bring together various stakeholders, processes, and technology systems operating under the Insolvency and Bankruptcy Code, 2016. The platform will help to minimise delays, improve transparency, increase participation by resolution applicants, facilitate effective decision-making, and maximise value in insolvency proceedings, the government said.
By integrating processes that currently operate in silos across the insolvency system, the platform will reduce manual intervention during process transitions and support real-time flow of information, it said. It will also help identify cases facing bottlenecks, facilitate the tribunal's prioritisation of cases, and attract market participants, including interim finance providers and resolution applicants, through a unified portal.
The platform will integrate data from key insolvency institutions in the insolvency ecosystem, including the National Company Law Appellate Tribunal, the National Company Law Tribunal, the Ministry of Corporate Affairs, the Insolvency and Bankruptcy Board of India, information utilities, and insolvency professionals, onto a single platform, the government said.
By bringing these entities together, the platform will improve workflow integration, enhance collaboration among stakeholders, including creditors and market participants, and streamline the functioning of the insolvency ecosystem, it said.
The module will facilitate the creation and publication of expressions of interest, invite resolution plans, evaluate responses, and submit the final resolution plan to the tribunal for approval. It will also record the tribunal's approval or rejection of the resolution plan on the platform, the government said. The module will facilitate the implementation of the approved resolution plan after the tribunal issues its approval order, it said.
The platform will streamline the management of legal disputes before tribunals and appellate tribunals, enabling efficient handling of cases from the identification of legal issues through their resolution. It will also monitor, analyse, and control insolvency-related expenses through expense categorisation, cost tracking, analysis of cost variance across different stages of the process, and monitoring approvals by the committee of creditors for various cost components, it said.
The platform will integrate multiple business processes and digital services into a common technology framework to provide a seamless, secure, and transparent user experience across the insolvency lifecycle, the government said. It will support end-to-end digital workflows, facilitate information exchange among authorised stakeholders, and reduce dependence on manual processes. The platform will also include a mobile application for critical processes.
The platform will facilitate the initiation of an insolvency by generating a unique case identification number, linking cases with the National Company Law Tribunals, creating case timelines, retrieving debt-default information and relevant data from the Insolvency and Bankruptcy Board of India portal, facilitating public announcements inviting claims, and supporting task assignment and tracking, it said.
The ministry has invited comments, feedback, and suggestions from stakeholders on the proposal by Aug. 3. End
