NEW DELHI – A petition has been filed in the Supreme Court seeking a probe by the Central Bureau of Investigation into allegations of bribery against Adani Green Energy Ltd. and its associates to secure solar power contracts across several states. The petitioner Jitendra Maru, an activist, has sought that the Central Bureau of Investigation register a first information report in the case under the Prevention of Corruption Act, 1988. Maru has challenged the Bombay High Court's rejection of his petition.

 

Maru had relied on the proceedings of a US criminal indictment and a parallel Securities and Exchange Commission case before a court in the US. Maru alleged that there was an organised bribery scheme by Adani Green and a Delhi-based renewable energy firm, Azure Global. The alleged scheme consisted of an agreement to pay INR 20 billion to bribe officials of state power distribution companies in Andhra Pradesh, Tamil Nadu, Maharashtra, Odisha, Chhattisgarh and Jammu and Kashmir to ensure they entered into pacts at inflated tariffs and purchased more solar power, said Maru.

 

These payments were mentioned in the "bribe notes" and electronic records maintained by Adani Green Energy executive director, and were taken by the US Federal Bureau of Investigation, which reproduced them before US courts, Maru said. The petitioner sought that the CBI should obtain all the texts of the "bribe notes" and electronic data records taken away by US authorities.

 

Rejecting Maru's claims, the high court had said the petition was clearly an abuse of the court's process. Petitions of this kind, or petitions masked as public interest litigation, are filed at the behest of failed competitors, a rival business house, or a disgruntled person, the high court had said.

 

The petitioner has failed to establish his bona fide, said the high court. The petitioner has no locus to file the writ petition, and has not approached the court with clean hands, it said. This petition does not serve any public purpose. Rather, a petition like the present one causes serious harm and is likely to cause harm to the reputation and business prospects of any corporate group, the high court had said.

 

Friday, Adani Green Energy's shares ended 1.9% lower at INR 1,513.90 on the National Stock Exchange.  End
