NEW DELHI – The Delhi High Court Monday asked the American multinational technology company Meta Platforms Inc. to take down infringing content from its social media platforms which originally belonged to Zee Entertainment Enterprises Ltd. The high court sought Meta's reply on Zee Entertainment's plea that some infringers were putting content on Meta on a real time basis illegally and through multiple rogue accounts, said Zee Entertainment. These infringers are monetising content by carrying advertisements on the respective Facebook pages and Meta is also benefiting from such monetisation, said Zee Entertainment.

 

The high court said that it was prima facie satisfied that an ex-parte ad-interim order is needed to direct Meta to remove the infringing content from its platforms. However, a blocking order to infringers' account cannot be passed at this stage without hearing them, said the court.

 

Zee Entertainment has said that they have asked the source from Meta of the links being shared for streaming the infringing contents. However, Meta has claimed that the offenders have a right to privacy and the company can't share their data, said Zee Entertainment. 

 

When the notices were issued to Meta to remove the content, the American company sometimes carry out the take down but that is restricted to certain geographical locations and the same infringing content shows up in other locations, said Zee Entertainment. Meta is failing in its duty to remove the content and are actually liable for action, said Zee Entertainment.

 

Earlier, Zee Entertainment had filed a suit in the high court against FSN E-Commerce Ventures Ltd., which operated Nykaa, for allegedly using its copyright songs in Instagram reels to promote its products, seeking $210,000 in damages. Nykaa had told the Delhi High Court that Meta must be included in the suit, as only it can "authoritatively state whether use" of music clips by Nykaa breached any licence terms.

 

At 1350 IST, the shares of Zee Entertainment Enterprises Ltd. were up 1.0% at INR 98.44 on the National Stock Exchange.  End
