Dutch body summons Tata Steel IJmuiden on suspicion of criminal offences

MUMBAI – The Public Prosecution Service of the Netherlands has summoned Tata Steel IJmuiden BV on suspicion of multiple criminal offences, including intentional and unlawful release of harmful substances into the air, according to a statement by the prosecution body. Tata Steel IJmuiden BV is an indirect wholly-owned subsidiary of Tata Steel Ltd.

 

The company is also suspected of violating its "duty of care," including insufficient maintenance, acting without a permit, and failure to report a number of incidents involving raw coke, which is formed after coal is heated. The first preliminary hearing is scheduled for Nov. 20 at the Amsterdam District Court, as per the statement. The prosecution body will then announce exactly what charges are being brought against Tata Steel.

 

The Dutch body is also conducting an investigation into whether individuals in managerial roles might be "personally liable." "The Public Prosecution Service has decided to summon the company now to maintain progress in the criminal case. It may take some time before the Public Prosecution Service can make further announcements regarding the second part of the investigation into potentially involved persons," it said.

 

A criminal investigation was launched against the company after a complaint was filed by a lawyer on behalf of more than 800 complainants. The investigation initially focused on the production process and the operation of Tata Steel's coke gas plants. "After reviewing the case file, the Public Prosecution Service is of the opinion that the criminal investigation offers sufficient grounds to initiate criminal prosecution against the company and bring the case before the court," the statement read.

 

At 1253 IST, shares of Tata Steel were down 0.2% at INR 189.39 on the National Stock Exchange. For the March quarter, Tata Steel reported a consolidated net profit of INR 29.26 billion on revenue of INR 632.70 billion.  End
