NEW DELHI – The Bombay High Court has refused to restrain Cognizant Technology Solutions US Corp. and Cognizant Technology Solutions India Pvt. Ltd. from using its logo in India, which Atyati Technologies Pvt. Ltd. alleged was similar to the latter's device mark. There is no goodwill and reputation demonstrated by Atyati Technologies in respect of the standalone logo, the high court said, rejecting the company's interim injunction plea.

 

Even if belonging to the information technology services space, there is distinct separation of nature and scale of services being offered and the class of customers who avail these services, said the court. Atyati Technologies' customer segments include public sector banks and regional rural banks, whereas Cognizant's customers are Fortune 500 corporations, including global multinational companies, it said. 

 

The services are rendered mainly to institutional clients who are discerning and there would not be any confusion that Atyati's services are of Cognizant's, said the court. The decision makers at the helm would be well informed and technically literate and there is no likelihood of any confusion being caused and no question of confusion between the plaintiff's services and the defendant's services, said the court.

 

Atyati Technologies had adopted the house mark 'ATYATI' in 2008 in relation to information technology infrastructure, software development and consulting services, among others. In 2019, the company rebranded to a unique logo which features an orange-coloured hexagonal honeycomb symbolising collaboration, compassion and impact, depicted by the slightly inclined representation. The device mark was an original artistic work for which Atyati has copyright, said the petitioner.

 

In October 2023, Atyati Technologies became aware that Cognizant was offering information technology infrastructure, software development and consulting services using a similar logo, which bore a striking resemblance to the earlier adopted, used and registered Atyati's device mark. The addition of the corporate name 'Cognizant', minor changes in representation of the device mark, and the use of a different colour were of no relevance and amounted to infringement of Atyati's copyright in the device mark and of the registered 'ATYATI' mark and 'ATYATI' device mark, said the petitioner.

 

Cognizant had argued that Atyati Technologies had suppressed publicly available material which showed that its enterprise was one of the largest and most reputed IT solutions groups in the world and that there was absolutely no case either in law or in equity to support the grant of injunction. Atyati Technologies has been economical with the truth and has misled the court by suppressing publicly available material regarding its true date of adoption, said Cognizant.  End
