NEW DELHI – Brigade Enterprises Ltd. Thursday said that the revocation of environmental clearance for its residential project, Brigade Morgan Heights, in Chennai is "legally unsustainable, factually incorrect and arbitrary". The company will pursue legal and regulatory remedies against the order, it said.

The real estate developer said the State Level Environment Impact Assessment Authority revoked the environmental clearance granted for the project in Perumbakkam village, Chennai, without providing prior notice, personal hearing, site verification, or an opportunity to submit documentary evidence.  

"We reiterate that the project site is private patta lands, classified as dry lands ("punjai") in revenue records dating back to 1935, and has been in the continuous possession of the current landowners since 1985," the company said in the exchange filing.

According to the company, the environmental clearance was cancelled based on a standard condition requiring approval from the Wetland Authority. The company argued that the condition was not applicable as no authority had conclusively declared the project land to be a wetland.  
 

The company entered into a joint development agreement for the land in 2022 and said no objections were received when public notices were issued before obtaining the environmental clearance. The company also cited an Oct. 28, 2025, clarification from the Tamil Nadu Environment, Climate Change and Forest Department, which stated that "the lands are private patta lands and that the approvals were given by concerned authorities on private patta lands only and that final wetland boundaries remain undecided". 

The company further said the Madras High Court, while dismissing a public interest litigation against the project on Feb. 10, had observed that the project land could not be conclusively designated as wetland until ground-truthing under the Ramsar process was completed. The company noted that none of the authorities involved in the case had sought cancellation of approvals during the proceedings.

Brigade Enterprises said substantial investments have already been made in the project, construction was underway, and third-party rights created. It added that the proposed Ramsar site and its zone of influence cover more than 11,000 acres in South Chennai, affecting several projects, developers and landowners in the region. The company said it is appealing against the revocation order and exploring all available legal and regulatory options.

For the March quarter, Brigade Enterprises had reported consolidated net profit of INR 1.45 billion on revenue of INR 14.58 billion. On Thursday, shares of the company closed 2% lower at INR 554.60 on the National Stock Exchange.  End
