NEW DELHI – Amara Raja Energy & Mobility Ltd's batteries that are similar to Exide Industries Ltd.'s and are with the former's franchises, distributors and retailers must be sold by a third party, the Supreme Court has said. While Amara Raja's batteries lying unsold with distributors and franchises were valued at INR 249.90 million, its batteries with retailers had an estimated value of INR 156.00 million. 

 

The apex court has asked Amara Raja Energy to sell its existing stock of batteries in any other package that is not red in colour or similar to Exide Industries' trade dress. Amara Raja Energy has in its possession 20,789 units of batteries that are similar in trade dress to Exide Industries, and these are valued at INR 26.30 million. The empty cartons of Amara Raja's products, similar in packaging to Exide Industries, will be destroyed, the apex court said. 

 

The top court noted that Amara Raja has not produced batteries red in colour after Apr. 2, the day on which the temporary injunction order was affirmed by the Calcutta High Court. It upheld the high court's order barring Amara Raja from manufacturing and selling batteries with a trade dress similar to Exide Industries till the permanent injunction suit filed by the latter was decided.

 

Exide Industries had said it always used a distinctive colour theme, predominantly red, and has become linked with its trade dress. Exide Industries also uses a distinctive red and white colour for its products and incidentally uses other colours. Further, Exide Industries enjoys trademark registration of "EL" and a "shattered O device". Amara Raja has, since its inception, always sold its products in a predominantly green colour. 

 

Exide Industries had earlier moved the high court after Amara Raja launched its battery Elito, predominantly with a red trade dress and also bearing a red and white combination, along with a "shattered O device". It said Amara Raja batteries' trade dress was not only predominantly red in colour, but also had other deceptive similarities such as the words "EL" and the "shattered O device", which were strikingly similar to that of the respondent. 

 

On Wednesday, shares of Amara Raja Energy & Mobility Ltd. ended 0.8% lower at INR 859.05 on the National Stock Exchange, and shares of Exide Industries Ltd. ended 1.8% lower at INR 398.95.  End
