NEW DELHI – The Supreme Court Thursday referred late businessman Sunjay Kapur's wife Priya Kapur and his mother Rani Kapur to mediation to resolve disputes over the ownership of the family trust, which holds a stake in Sona BLW Precision Forgings Ltd. The apex court appointed former chief justice of India D.Y. Chandrachud as the mediator to resolve the dispute between the parties. The apex court's order came after all the parties agreed to go for mediation.
"It's a family dispute; let it be confined among the family only. It should not be a source of entertainment," said a bench of Justice J.B. Pardiwala and Justice Ujjal Bhuyan. The mediation would be confined to disputes among family members and all the parties should participate in the mediation proceedings with an open mind, said the court. "This being a family affair, the endeavour on their part should be to get the disputes resolved at the earliest," said the court. It would await a preliminary report from the mediator before proceeding further, said the court, listing the case for hearing in August.
Earlier, the top court had said, "Why are you all fighting? This is not the age for your (Rani Kapur) client to fight. Go for mediation once and for all, from A to Z (parties). Otherwise, this is a waste." The apex court had said that merely prolonging litigation achieves little, particularly when disputes arise at an advanced age. "You (Rani Kapur) are 80. This is not the age for your client to fight," it said. The apex court was hearing Rani Kapur's plea seeking directions to restrain Priya Kapur and others from interfering with the estate, assets and related affairs under the RK Family Trust.
Rani Kapur said that the estate has not been adequately preserved and there was a possibility of dissipation of assets. Courts typically grant protective orders at an early stage in disputes involving large estates. However, the Delhi High Court has not given any relief on her petition, Rani Kapur said.
Earlier this year, Rani Kapur had moved the high court seeking to scrap the RK Family Trust and all assets and benefits in the trust be given to her. Rani Kapur said that Sunjay Kapur and Priya Kapur had fraudulently diverted her entire family legacy, estate, and movable and immovable assets originally inherited by her to the RK Family Trust. Rani Kapur had sought a permanent injunction against Priya Kapur and others from utilising or acting in furtherance of the RK Family Trust in any manner whatsoever. She has sought rendition of accounts of the RK Family Trust, from its inception, among other relief.
On her part, Priya Kapur alleged perjury against Rani Kapur and sought dismissal of the latter's suit, alleging that she had grossly abused the process of the court, constituted a fraud upon the court by concealing and suppressing material facts and documents, and knowingly made false statements. The Delhi High Court is currently hearing both parties' cases without passing an order on the preservation of assets under the trust.
In 2015, Rani Kapur's husband, the late Surinder Kapur, passed away and left his entire estate, including all shares of various companies under Sona Group and his other movable and immovable properties, exclusively to Rani Kapur through a will. According to the petition, Rani Kapur was the sole beneficiary and legatee of her husband's entire estate, who was the promoter of various businesses, including the Sona Group of companies.
The petitioner said that through a complex web of illegal transactions undertaken by Priya Kapur and others, in collusion with Sunjay Kapur, all her assets were now vested in the RK Family Trust without her knowledge. The entire fraud perpetrated upon her has been discovered only now, post the demise of her son, who passed away under mysterious circumstances in June last year, Rani Kapur said.
Sunjay Kapur, former chairman of auto parts company Sona BLW Precision Forgings, died in the UK while playing polo, with initial reports citing cardiac arrest as the cause. His death triggered a bitter power struggle within the Kapur family over control and inheritance of the Sona Group empire. Kapur's father was a pioneer of India's auto components industry and had founded the group.
At 1319 IST, the shares of Sona BLW Precision Forgings traded 0.4% lower at INR 580.50 on the National Stock Exchange. End
