HC bars Priya Kapur from alienating husband's assets on challenge to will

NEW DELHI – The Delhi High Court Thursday restrained Priya Kapur, the third wife of late Sunjay Kapur, from alienating, transferring, and pledging assets of the deceased, on a plea by the children of his second wife, actress Karisma Kapoor, seeking a share in their father's assets. The late businessman's assets are estimated at INR 300 billion.
The children of Karisma Kapoor have cited suspicious circumstances, such as chain of custody of the original will and unnatural disposition, to challenge Sunjay Kapur's will.
Further, the court restrained Priya Kapur from changing the equity shareholding in Sona BLW Precision Forgings Ltd., of which Sunjay Kapur was chairman, and other related companies. The restraining order will be in force till the court decides on the children's plea.
The high court also restrained Priya Kapur from withdrawing monies from the three accounts mentioned in the plea, except to the extent of discharging liabilities towards the children under the decree of divorce and the mother of the children. The court has restrained her from operating the foreign bank accounts and selling, transferring or in any manner dealing with cryptocurrency disclosed in the list of assets and also from moving it to another wallet.
The high court said that since suspicious circumstances have been raised by the children against the will, it will be the onus of Priya Kapur to remove these before the will can be accepted as a valid document. Will is a document that represents the desire of the deceased when he is not available to speak the truth, said the court. Genuineness of the will is now a matter of trial in light of the suspicious circumstances, and since the trial will take time, the assets of the husband should not be dissipated in the meantime, said the court.
The petitioners have sought a declaration that being class I legal heir they are entitled to their respective share in the personal assets and effects of their father in accordance with applicable inheritance laws. The petitioners have urged the court to pass a preliminary decree for a partition in their favour, saying they are entitled to and should each be given a fifth of their father's assets. They have also sought an order to appoint a local commission to effect the partition of assets. They requested the court to pass a decree of permanent injunction restraining the defendants from alienating, transferring, selling, or in any manner creating third-party interests in any of the personal assets of their father.
In June, Sunjay Kapur died unexpectedly while playing polo in the UK, with initial reports citing cardiac arrest as the cause. His death triggered a bitter power struggle within the Kapur family over control and inheritance of the Sona Group empire. Kapur's father was a pioneer of India's auto components industry and had founded the group. In July, the petitioners and their mother were informed of Sunjay Kapur's last will. They were told that the entire personal assets of their father have been bequeathed to Priya Kapur.
Advocate Mahesh Jethmalani, appearing for the petitioners, argued that the will by Sunjay Kapur was not registered. The father was meticulous in securing the properties of the children and it was surprising that the petitioners were left out from the will, said Jethmalani. Advocate Vaibhav Gaggar, appearing for Sunjay Kapur's mother Rani Kapur, said his client, who was 80 years old, had received nothing from the will while his third wife had got assets from the same.
Karisma Kapoor and Sunjay Kapur had got married in 2003. Their marriage was dissolved by mutual consent in 2016. Thereafter, in 2017, Sunjay Kapur married Priya Kapur. They have a son, Azarius S. Kapur.
Shares of Sona BLW Precision Thursday closed 1.3% higher at INR 607.25 on the National Stock Exchange. End
