Twenty Four Seven withdraws plea in HC vs Godfrey Philips on '24Seven' mark

NEW DELHI – Twenty Four Seven Retail Store Pvt. Ltd. has withdrawn a suit from the Delhi High Court against its former stakeholder Godfrey Phillips India Ltd. on the usage of "24Seven" trademark by the latter. "We would now like to inform you that on 8th April 2026, the plaintiffs have unconditionally withdrawn the said suit filed against the company under Order XXIII Rule 1(1) of the Code of Civil Procedure, 1908," said Godfrey Philips in an exchange filing.

 

Godfrey Phillips had entered the retail sector in 2005 and established 24Seven convenience store chain. The company expanded the 24Seven to around 150 outlets by 2023. In 2024, Godfrey Phillips exited the retail business and stopped using the "24Seven" trademark.

 

Twenty Four Seven Retail Store moved the high court alleging that Godfrey Phillips was still using the "24Seven" trademark unauthorisedly, despite its exit from the retail business. The use of the "24Seven" trademark by Godfrey Phillips post its exit harmed the brand's goodwill and market reputation, said the petitioner. Godfrey Phillips said that its business in relation to the "24Seven" trademark stopped from Jul. 31, 2024 and that the usage of the same was stopped from Oct. 10, 2024. The high court noted Godfrey Phillips' undertaking that the company will not use the "24Seven" trademark.

 

Last year, Twenty Four Seven Retail Store filed a contempt petition against Godfrey Phillips for continuing to use the "24Seven" trademark. However, the high court rejected the contempt plea and said that Twenty Four Seven Retail Store was unable to point out use of the "24Seven" trademark by Godfrey Phillips.

 

On Thursday, shares of Godfrey Phillips ended 1.5% higher at INR 2,034.80 on the National Stock Exchange.  End
