Delhi HC orders German Rosenberger to pay INR 1.5 bln damages to Candian co

NEW DELHI – The Delhi High Court has ordered German company Rosenberger Hochfrequenztechnik GmbH & Co. KG and its Indian entities to pay INR 1.52 billion in damages to Canadian company Communication Components Antenna Inc. for infringing a patent related to "asymmetrical beams for spectrum efficiency". The amount must be paid by Jun. 30, failing which simple interest at 7% will apply, the court said. 

 

Communication Components' patent is a high-capacity cellular antenna technology, which uses asymmetrical beam patterns to replace single-sector coverage areas, increasing subscriber capacity and reducing interference in third-generation universal mobile telecommunications systems and long-term evolution networks.

 

The high court granted a decree of permanent injunction restraining the German company and its Indian entities from selling and promoting any antenna which infringes Communication Components' patent. The damages on the sales that were not accounted for will be calculated at 20% of those sales and should be paid to the petitioner by Jun. 30, the court said.  

 

Noting that the petitioner's patent was valid, the high court asked its registry to issue a certificate of validity on Communication Components' patent. "The beam patterns, as emerging from the plaintiff's patent and the defendant's brochures, when overlaid above each other at different weightings and values, show a near identity in the beam patterns," said the court.  End
