HC allows Dr Reddy's to sell stock of diabetic drug Olymviq for 30 days

NEW DELHI – The Delhi High Court Monday allowed Dr. Reddy's Laboratories Ltd. to sell the existing stock of its diabetes drug 'Olymviq' for 30 days. After the 30 days, the court asked the company to donate the remaining stock to a government hospital. The order follows Dr. Reddy's Laboratories agreeing to change the name of Olymviq after the court said the name of the drug was prima facie similar to that of Novo Nordisk's Ozempic drug.

 

The court noted an agreement between Dr Reddy's and Novo Nordisk to change the drug's name to 'Olymra' following the suit filed by the Danish company. The high court rejected Novo Nordisk's prayer that the existing stock of Olymviq should be destroyed.

 

Danish drugmaker Novo Nordisk held a primary patent for diabetes and obesity drug semaglutide, which expired in September 2024. Novo Nordisk's secondary patent in India relating to the manufacturing process and delivery mechanism of the semaglutide drug expired on Mar. 20. Following this, Dr. Reddy's launched semaglutide injections under the brand names Obeda and Olymviq.

 

Pharmaceutical trademarks are subject to a heightened anti-confusion standard, where even a possibility of confusion must be avoided in the public interest, Novo Nordisk had said its trademark infringement suit against Dr Reddy's. 

 

Monday, shares of Dr. Reddy's Laboratories ended 2.1% lower at INR 1,254.90 on the National Stock Exchange.  End
