NEW DELHI – The division bench of the Delhi High Court has set aside its single judge bench's 2025 order that allowed Cambro Nilkamal Pvt. Ltd., a joint venture of Nilkamal Ltd. with US-based company Cambro USA, to sell induction cooktops under the brand name Stella, Stelladexin and other similar names on a plea by Products and Ideas (India) Pvt. Ltd. The bench of Justice C. Hari Shankar and Om Prakash Shukla asked the single judge bench to hear the matter on use of brand name Stella and others and decide it afresh.
Till the time a fresh decision is taken by the single judge bench, the injunction against Cambro-Nilkamal from selling induction cooktops under the brand name Stella and similar names will remain in force. The division bench asked the parties to appear before the single judge bench on Apr. 2.
Products and Ideas (India), a company dealing in commercial kitchen and bakery equipment in India, was selling commercial induction cooktops under the brand name Stelladexin. The Stelladexin mark was adopted by Stella Industrial Co. Ltd., a Chinese company, which had allowed Products and Ideas (India) to use the brand name and authorised it to register the said trademark.
Products and Ideas (India) and Stella Industrial had entered into an exclusive agency agreement in 2017, wherein the former was appointed as the exclusive agent for the distribution, sale and promotion of induction cookers under the brand Stella. Stella Industrial was an original equipment manufacturer and was supplying goods to Products and Ideas (India) through its local partners under the agreement.
In 2024, it came to the knowledge of Products and Ideas (India) that Cambro-Nilkamal and its distributors were selling the induction cooktops under the brand name Stella which was similar to the former's registered trademark Stelladexin. Aggrieved by the aforesaid, Products and Ideas (India) filed a suit seeking relief of permanent injunction along with other ancillary reliefs, which were still pending in court.
Thereafter, the single-judge bench of high court in 2024 had passed an interim injunction order in favour of Products and Ideas (India), restraining the joint venture company from selling induction cooktops under Stella or similar names. However, the single judge in 2025 vacated its order, noting that the grant of interim injunction would create the monopoly in favour of Products and Ideas (India) and allowed Cambro-Nilkamal to sell induction cooktops under Stella or similar names. In an appeal, the division bench set aside the single judge's 2025 order.
At 1358 IST, shares of Nilkamal were trading 3.8% lower at INR 1,084.30 on the National Stock Exchange. End
