HC OKs Power Grid's ban on KEC Intl from tenders, to review other companies' ban

NEW DELHI – The Delhi High Court Thursday upheld an order issued by Power Grid Corp. of India Ltd. banning KEC International Ltd. from participating in any of its tenders for a period of nine months started Nov. 18, 2025. However, the court said it would hear KEC International's plea on a limited aspect that other companies were also banning the petitioner from future tenders on the basis of Power Grid Corp.'s ban, due to specific conditions in their tender process.
The court sought Power Grid Corp.'s reply on KEC International's plea on the aspect of other companies banning the latter from future tenders. It will next hear the case on Jan. 19. The court asked the petitioner to approach them if some action was taken against the company in the meantime.
In November, and followed by a supplementary order in December, Power Grid Corp. had blacklisted KEC International for nine months for alleged transgression of contractual provisions and a corruption-related matter in which the Central Bureau of Investigation had arrested some officials of both these companies over an alleged INR 250,000 bribery scandal. On Thursday, the high court noted that the petitioner was listed as an accused in the CBI case, in which its senior employees had allegedly paid bribes to the respondent company. The court said that "it was not inclined to entertain this petition," adding that "they (Power Grid Corp.) are already considerate to debar you (KEC International) for nine months, they could have debarred you for two years."
The petitioner argued that because of Power Grid's ban, other companies were ousting it from future contracts. Power Grid's ban order is being operated by other companies through their tender processes by putting certain conditions and it is acting as "multiple debarment" for the petitioner, for which there is a different process, said the company.
On Thursday, shares of KEC International ended 4.5% lower at INR 684.80 on the National Stock Exchange, and those of Power Grid Corp. ended 1.8% lower at INR 259.30. End
