HC asks patent controller to decide afresh on Trident air rich fabric patent

NEW DELHI – The Delhi High Court has asked the Controller of Patents to decide afresh on Trident Ltd.'s plea seeking registration of patent on air rich yarn and fabric and its method of manufacturing. The high court has set aside the 2021 order of the Controller of Patents that had rejected Trident's plea for patent registration.

 

The matter shall be decided by another Controller of Patents than who passed the 2021 order. The Controller of Patents shall decide the matter on the merits in accordance with the law, uninfluenced by any observations made by the high court, within a period of six months, said Justice Tejas Karia.

 

"The decision of the learned controller that there are no special measures adopted to achieve uniform radial distribution of fibres in the yarn cross-section cannot be accepted without addressing the exemplary manufacturing parameters used by the appellant to manufacture yarn / fabric in accordance with the teachings of the claimed invention," said the high court. Therefore, the reasoning of the Controller of Patents cannot be accepted, which states that Trident has failed to suggest any special measures adopted to achieve uniform radial distribution of fibres in the yarn cross-section, said the court.

 

Trident is a leading manufacturer of yarn, bath linen, bed linen, wheat straw-based paper chemicals, and captive power. The company is part of the Trident Group, whose diverse portfolio includes products like bed and bath textiles, paper, and yarn. The Ludhiana-based group has presence in over 150 countries. In 2010, Trident had filed an application for grant of a patent on air rich yarn and fabric and its method of manufacturing. In 2021, the Controller of Patents rejected Trident's application observing that the claimed invention lacks inventive steps.

 

The petitioner said the patents relate to novel air rich fabric and yarns with pores throughout the cross-section and processes for making an air rich fabric. The objective of the claimed invention is to provide fabrics, which are highly wettable, easily dryable, quick absorbing, and thicker, said Trident. The claimed invention also discloses terry fabrics that can absorb about 75% to 100% of water contacting them and dry with a drying rate 10% to 30?ster than normal fabric, the company added. There are two corresponding patents granted to the company by the US Patent Office, and the European Patent Office, the company said.

 

Trident's net profit for the September quarter rose almost 11% on year to INR 924.1 million. Revenue from operations for the quarter rose 4.4% to INR 17.85 billion. Sequentially, the net profit fell 33.7%, while revenue rose 5%. At 1318 IST, shares of the company were down nearly 1% at INR 28.11 on the National Stock Exchange.  End
