NEW DELHI – The Delhi High Court Monday asked Gurugram-based Tesla Power India Pvt. Ltd. not to issue any promotional advertisements featuring electric vehicle products with the "Tesla" brand until the main injunction suit filed by US electric vehicle giant Tesla Inc. was decided. The high court noted that Tesla Power Chief Executive Officer Kavinder Khurana's undertaking that the company had no plans to enter the electric vehicle market will remain in force till the main case was decided. The court also asked Tesla Power not to use the "Tesla" name in selling lead acid batteries for automobiles and inverters.
In March, the high court had started hearing Tesla Inc.'s plea against Tesla Power after mediation proceedings between the parties failed. Tesla Inc., a US-based multinational automotive and clean energy company, had moved court in May last year and said that Tesla Power's use of "Tesla" trademark in India was causing confusion among consumers and potentially harming its business interests. Tesla Inc. said consumers were mistakenly buying Tesla Power's batteries assuming they were associated with the US company and thereafter registering complaints with them.
Tesla Power said it was not manufacturing electric vehicles but only selling lead acid batteries for automobiles and inverters. In the hearing on May 2, 2024, Tesla Power CEO Khurana had submitted to the court that the company had no plans to enter the electric vehicle market and the advertisements featuring the Tesla trademark were related to another company, e-Ashwa, with which it has a strategic partnership to sell branded products. Khurana's statement came after Tesla Inc.'s advocate Chander Lall had said Tesla Power was advertising its batteries in national dailies using the Tesla logo.
However, Tesla Inc., on May 28, 2024, had said that despite an undertaking by Tesla Power, electric scooters were sold by the Gurugram company through dealers under various sub-brands. The court had then asked Tesla Power to file an affidavit on the number of electric scooters sold and the current stock available with them.
On May 30, 2024, Tesla Power told the court that it had written to its vendors and partners to remove the Tesla marks on the electric scooters. Tesla Power had said, "We don't wish to sell anything beyond the undertaking." The Gurugram company said that emails were sent to all its franchises to not sell anything under the company's brand and remove them accordingly.
In July, Tesla Inc. officially entered the Indian market with the launch of its mid-sized sport utility vehicle Model Y, with on-road prices starting at INR 6.11 million in Mumbai. The company launched the car at its first-ever showroom in India, at Mumbai's Bandra-Kurla Complex. End
