Delhi HC refuses to allow Johnson & Johnson arm to sell remaining ORSL drink

NEW DELHI – The Delhi High Court Wednesday refused to allow American multinational pharmaceutical company Johnson & Johnson's subsidiary JNTL Consumer Health India Pvt. Ltd. to sell its remaining INR 1 billion worth of ORSL Electrolyte drink stock. The high court said that there was a possibility that people with diarrhea may be misled into buying JNTL Consumer's stock if it were allowed in the market.
"A person suffering from diarrhoea, I am not saying this happens in every case. But ordinarily, people do not go to the doctors in cases of diarrhea. What happens is that they generally go and buy ORS (oral rehydration solution) that balances the electrolytes. What you are writing on your drink is that it is an energy drink with electrolytes. There is every possibility of the person being misled," the court said.
The Food Safety and Standards Authority of India had last month issued a directive that using 'ORS' (oral rehydration solution), even with prefixes or suffixes in trademarked names, was misleading and violated the Food Safety and Standards Act, 2006, unless the product adhered to the World Health Organization's formulation. Essentially, the directive banned companies from using the term 'ORS' in product names or branding unless they meet the standard medical formulation. End
