SC notice to govt on plea to implement reservation for women in legislature

NEW DELHI – The Supreme Court Monday issued a notice to the Centre on a petition seeking implementation of the law to reserve seats for women in the Lok Sabha, and the legislative assemblies of states and the National Capital Territory of Delhi. The petitioner, Jaya Thakur, has challenged a provision that reservation of seats for women in legislature will come into effect after an exercise of delimitation is undertaken for this purpose after the next census. Thakur is a leader of the Indian National Congress.

 

"Preamble says political and social equality. Who is the largest minority in this country? It is the woman, almost 48 percent. This is about the political equality of women," said a bench of Justice B.V. Nagarathna and Justice R Mahadevan. Observing that enforcement of a law is the executive's domain, the top court sought the Centre's reply on Thakur's petition. 

 

In September 2023, President Droupadi Murmu had given her assent to the The Constitution (106th Amendment) Act, 2023, which seeks to provide 33% reservation to women in the Lok Sabha and state assemblies. However, the quota can be implemented only after the first delimitation or redrawing of constituencies after the next census is completed. The next census isn't likely before 2027.  End
