HC junks Quantum Hi-Tech plea to bar LG Electronics from using 'Quantum'

NEW DELHI – The Delhi High Court Tuesday rejected Quantum Hi-Tech Merchandising Pvt. Ltd's interim injunction plea seeking to restrain LG Electronics India Ltd. from using the mark 'Quantum' and 'Quantum Display'. The court said Quantum Hi-Tech had resorted to wilful and deliberate concealment of facts.

 

Quantum Hi-Tech was well aware of the fact that it had never applied for registration of the word mark 'Quantum', it said. Its application for registration was only for the device mark. However, the trademarks registry granted the appellant a registration for the mark 'Quantum' against an application for the device mark. This registration is obviously invalid, said the court, adding that the petitioner had managed to conceal this fact from the lower court, where the main suit had been filed.

 

The entitlement to interim injunction is dependent on a party coming to the court with clean hands, which was not the case in Quantum Hi-Tech's plea. "For the above reasons, we uphold the finding of the learned commercial court that the appellant has resorted to deliberate concealment of facts and, on that ground, decline to interfere in the present appeal, which is, accordingly, dismissed with no orders as to costs," said the court.

 

The high court was hearing Quantum Hi-Tech's plea alleging infringement by LG Electronics of its registered trademarks 'Quantum' and 'Quantum Display'. LG Electronics was manufacturing television sets and their accessories, headphones, earphones, portable communication apparatus and other similar goods under the Quantum trademark, said Quantum Hi-Tech. The main suit by Quantum Hi-Tech against LG Electronics was pending before the District Judge (Commercial Court-II), Shahdara.  On Tuesday, shares of LG Electronics India ended 1.0% lower at INR 1,633.40 on the National Stock Exchange.  End
