NCLT admits insolvency proceedings against Blu-Smart Mobility Tech

NEW DELHI - The Ahmedabad bench of the National Company Law Tribunal has admitted Lepton Software Export and Research Pvt. Ltd's plea to start insolvency proceedings against Blu-Smart Mobility Tech Pvt. Ltd. for an unpaid amount of INR 58.44 million. The tribunal appointed Pawan Kumar Goyal as the interim resolution professional of Blu-Smart Mobility Tech promoted by Anmol Singh Jaggi and Puneet Singh Jaggi to carry out the functions as per the Insolvency and Bankruptcy Code, 2016. The admission of insolvency against Blu-Smart Mobility Tech comes after Gensol Engineering Ltd., a company also promoted by the Jaggi duo, was admitted into bankruptcy in June.

 

Lepton Software is engaged in the business of reselling Google map platform products under requisite rights granted to it by Google Asia Pacific Pte. Ltd. Accordingly, Lepton Software sells Google Map products to its Indian and Asia Pacific customers under the "Pay As You Go" model and also based on the purchase orders placed with the Operational Creditor by such customers.

 

Blu-Smart Mobility Tech had approached Lepton Software to obtain the 'On-demand Rides and Deliveries Solution', offered under the 'Google Maps Platform Services'. For these, Blu-Smart Mobility Tech issued a purchase order and an agreement was signed. 

 

Thereafter, various invoices were raised by Lepton Software on Blu-Smart Mobility Tech. The invoices were duly shared through email with Blu-Smart Mobility Tech and the latter was obligated to make the payment for the same within the due date. However, despite sending numerous payment reminder emails, Blu-Smart Mobility Tech failed to clear the outstanding invoices. Consequently, Lepton Software filed an insolvency petition in the tribunal.

 

In April, the Securities and Exchange Board of India said it was probing Gensol Engineering and its promoters for diverting loans taken from Power Finance Corp. Ltd. and Indian Renewable Energy Development Agency Ltd. The regulator also issued an interim order against Gensol Engineering and its promoter directors Anmol Singh Jaggi and Puneet Singh Jaggi, barring them from any securities market-related activity and from holding the post of director or any key managerial position in the company till further orders.  End
