NCLT admits Tata Power EV Charging's insolvency plea against Cab-EEZ Infra

NEW DELHI – The Mumbai bench of the National Company Law Tribunal Wednesday admitted Tata Power EV Charging Solutions Ltd.'s insolvency plea against Cab-EEZ Infra Tech Ltd. for an unpaid amount of INR 19.13 million. The tribunal appointed Manish Lalji Dawda as the interim resolution professional of Cab-EEZ Infra to carry out the functions as per the Insolvency and Bankruptcy Code, 2016. Cab-EEZ is in the business of fleet management and application-based taxi services.
"...it is evident that the applicant is an operational creditor within the meaning of the IBC (Insolvency and Bankruptcy Code), that there exists a legally enforceable operational debt, that the CD (corporate debtor) has committed default in payment of such debt despite a statutory demand notice...," said the tribunal. It declared a moratorium on Cab-EEZ Infra under Section 14 of the 2016 Code.
In 2020, Cab-EEZ had entered into a master service agreement with Tata Power Co. Ltd., the parent company of Tata Power EV Charging, for getting unmanned electric vehicle charging services. Thereafter, from 2022, Tata Power EV Charging took over the services of providing electric vehicle charging from its parent company.
Tata Power EV Charging started issuing invoices directly to Cab-EEZ. However, Cab-EEZ did not pay its dues, following which Tata Power EV Charging sent demand notices to the corporate debtor. Upon failure to settle dues, Tata Power EV Charging filed the insolvency petition against Cab-EEZ in the tribunal.
Cab-EEZ is a Mumbai-based company operating the Cab-E brand, which is a "Green-Tech Urban Mobility Marketplace" focused on all-electric vehicle cab services. The company provides a mobile platform for city, inter-city, customised commuting and has recently partnered with Citroen India to supply 2,000 units of its e-C3 electric vehicles.
On Wednesday, the shares of Tata Power ended 1.3% higher at INR 396.50 on the National Stock Exchange. End
