Delhi HC grants protection of actor Hrithik Roshan's personality rights

NEW DELHI – The Delhi High Court Wednesday granted protection of personality rights of actor Hrithik Roshan and directed removal of certain links and websites which were using his image and voice for alleged commercial gains. The court said it will pass a detailed injunction order soon against the defendants who allegedly infringed on the actor's personality rights by using artificial intelligence and disparaging content for monetary gains.

 

However, the court refused to pass any order against fan pages of Roshan on social media at the interim stage. "I understand commercialisation, morphed, obscene but I don't understand fanclub takedowns. Instagram's use is not only to commercialise. People do it for fun and recreation. These pages are not defamatory to you (Roshan) at all. Most of the reliefs I agree to but not this," said Justice Manmeet Pritam Singh Arora.

 

Appearing for Roshan, advocate Sandeep Sethi argued that images of the actor were being used in merchandise like bags and shirts which were being sold for profit. There were also social media posts saying that Roshan tried to commit suicide, was on an overdose of drugs, and his career was over, said Sethi. Snippets were created using Roshan's image or clips from his films and his actual voice was substituted by his voiceover or writing which was demeaning, Sethi added. Referring to artificial intelligence-generated content, Sethi said anyone can talk to bots that use a voice similar to Roshan's. 

 

Last month, the high court had protected the personality rights of actor Abhishek Bachchan and his wife and actress Aishwarya Rai Bachchan. In 2022, actor Amitabh Bachchan was granted protection of personality rights from the high court. Other notable actors who have got similar relief include Jaikishan Kakubhai Saraf, aka Jackie Shroff, and Anil Kapoor.  End
