High court stays order restraining use of 'Kashmyr' mark by Radico Khaitan

NEW DELHI - Radico Khaitan Ltd. said the Punjab and Haryana High Court Thursday stayed a Sept. 23 order of the Karnal district court restraining it from using the mark "Kashmyr" for its vodka or other alcoholic beverages. The Karnal court's order has been kept in abeyance till the next date of hearing in the high court, the company said in an exchange filing.
Radico Khaitan said Piccadily Agro Industries Ltd. had filed a commercial suit against the company in the Karnal district court seeking to restrain it from using the trademarks "The Spirit of Kashmyr Indian Natural Vodka" and "The Spirit of Kashmyr Indian Saffron Vodka". The district court issued a temporary restraining order saying Radico Khaitan could not use the mark "Kashmyr" in any manner. The company went in appeal against the order to the high court.
Thursday, shares of Radico Khaitan closed slightly higher at INR 2,987.80 on the National Stock Exchange. End
