NEW DELHI – The Delhi High Court on Monday issued a notice to Vivanta Realty on a plea by Indian Hotels Co. Ltd. against use of the name 'Vivanta' by the former, which the petitioner said was its registered trademark. 

 

According to the petitioner, it had issued a cease and desist notice to Vivanta Realty, asking it to not use its registered trademark. In its reply, Vivanta Realty had undertaken to stop the commercial use of the 'Vivanta' trademark. The high court noted the statement of Vivanta Realty's counsel that it would take instructions on steps to be taken to immediately resolve the matter

 

The high court was hearing a permanent injunction suit by Indian Hotels Co against Vivanta Realty. The petitioner sought the court to restrain Vivanta Realty from using 'Vivanta' in its name. The 'Vivanta' trademark owned by Indian Hotels Co. Ltd., a member of the Tata group, was declared a "well-known trademark" by the Delhi High Court in 2022. The petitioner uses 'Vivanta' to brand its collection of sophisticated upscale hotels. 

 

At 1102 IST, shares of Indian Hotels Co. Ltd. were down 0.3% at INR 722.25 on the National Stock Exchange.  End
