Delhi HC restrains Svera Agro from using trade dress similar to Tata Salt

NEW DELHI – The Delhi High Court has restrained Svera Agro Ltd. and others from using a trade dress for its Narpa Himalayan Pink Salt product, which is similar to the packaging of Tata Sons Pvt. Ltd.'s Tata Salt Himalayan Rock Salt. The court's order came after Svera Agro willingly agreed to suffer the decree of permanent injunction and gave an undertaking that it would use a different packaging for its salt product.

 

The high court was hearing a permanent injunction suit by Tata Sons against Svera Agro. The petitioner had sought that the court restrain the respondents from infringing its trade dress for Tata Sons' salt product.

 

In 1983, the petitioner had launched Tata Salt, which according to Tata Sons was the pioneer of salt iodisation in India and held the distinction of being India's first national branded iodised salt. In 2018, with a view to provide a perfect blend of natural trace minerals such as calcium, magnesium and potassium, Tata Sons launched its rock salt product under the brand name 'Tata Salt Rock Salt' in small shaker bottles using a unique, peculiar and distinctive packaging and trade dress. With a view to further strengthen the brand positioning of its rock salt product, Tata Sons rebranded thid to Tata Salt Himalayan Rock Salt in 2023.

 

In its petition, Tata Sons said that its trademark, label, and packaging had acquired distinctiveness with the company's business activities and this entitles it to take action against its unauthorised use by third parties in relation to any class of goods or services. Tata Sons said that its products have acquired immense popularity and goodwill among consumers, as is evident from the substantial sales figures – a turnover of INR 1.17 billion in 2024-25.

 

In March, Tata Sons learnt that Svera Argo was manufacturing and selling rock salt products using packaging that was deceptively similar to its own label and packaging. Consequently, Tata Sons filed a permanent injunction suit against Svera Argo, which had been in business for about 25 years.  End
