NEW DELHI – The Delhi High Court has issued a summons to SpiceJet Ltd. in a suit filed by Tata Consultancy Services Ltd. seeking recovery of INR 23.39 million from the airline towards dues for service rendered since 2018. The court has issued a notice to SpiceJet on a plea by TCS to attach the airline's property at Indira Gandhi International Airport Terminal 1D in New Delhi. The court will hear the case next on Nov. 14.
In 2018, TCS and SpiceJet entered into a multipronged services agreement, whereby the plaintiff was tasked with developing and supporting the "SAP S/4 HANA" system to streamline the defendant's complex business operation. "SAP S/4HANA" is a widely-used enterprise software system that helps businesses manage their operations, including finances, supply chain, sales, production, and human resources. The plaintiff continued to provide services to SpiceJet under the agreement till 2023.
However, since 2020, SpiceJet fell behind in fulfilling its payment obligation to TCS. According to the petition, the plaintiff made multiple efforts to resolve the issue, including accepting payment plans provided by SpiceJet in order to accommodate the financial condition of the defendant. Despite the repeated failure in payment with regards to invoices and payment plans, the plaintiff continued to provide services to the defendant owing to the long-standing relationship between the two, said TCS.
In January 2024, SpiceJet acknowledged the outstanding dues but failed to settle the accounts despite receiving a comprehensive invoice breakdown, said TCS. Despite repeated follow-ups and updates, SpiceJet refrained from fulfilling its obligations, the petitioner said. Owing to the continued default, plaintiff issued a legal notice on Jun. 15, 2024, demanding payment from the airline. However, SpiceJet neither responded nor made any payment against the outstanding amount, said the petitioner. TCS, consequently, filed the recovery suit in the high court.
At 1400 IST, shares of SpiceJet were down 1.7% at INR 29 on the BSE and those of TCS were up 0.2% at INR 2,901.10 on the National Stock Exchange. End
