HC asks Sunjay Kapur's wife to furnish asset details in sealed cover

NEW DELHI – The Delhi High Court Friday allowed late Sunjay Kapur's wife Priya Kapur to file a list of all movable and immovable assets of the deceased known to her in a sealed cover. The high court took an undertaking from all parties that they would not disclose the contents of Sanjay Kapur's will to media. Further, the high court said that the copies of the will also be provided to Sanjay Kapur's former wife and actress Karisma Kapoor's children and his mother Rani Kapur.

 

The high court was hearing a plea by Karisma Kapoor's children Samaira Kapur and Kiaan Raj Kapur, seeking a share in their father's assets, which are estimated at INR 300 billion. On Sept. 10, the high court had registered the children's plaint as a suit and issued notices to Priya Kapur and other defendants.

 

The petitioners have sought a declaration that being Class I legal heirs, they are entitled to their respective shares in their father's personal assets and effects in accordance with the applicable inheritance laws. They have requested the court to pass a preliminary decree for partition in their favour, saying they are entitled to one-fifth of their father's estate. The petitioners have also sought an order to appoint a local commissioner to facilitate the partition of the assets.

 

Further, the petitioners have sought a decree of mandatory injunction directing Priya Kapur and other defendants to render full and complete records and accounts in relation to the late businessman's personal assets. The petitioners requested the court to pass a decree of permanent injunction restraining the defendants from alienating, transferring, selling, or in any manner creating third-party interests in any of the personal assets of their father.

 

In June, Sunjay Kapur, the chairman of auto parts company Sona BLW Precision Forgings Ltd., died unexpectedly in the UK while playing polo, with initial reports citing cardiac arrest as the cause. His death triggered a bitter power struggle within the Kapur family over control and inheritance of the Sona Group empire. Kapur's father was a pioneer of India's auto components industry and had founded the group.

 

Karisma Kapoor and Sunjay Kapur had got married in 2003. The marriage was dissolved by mutual consent in 2016. Thereafter, in 2017, Sunjay Kapur married Priya Kapur. They have a son, Azarius S. Kapur.

 

In July, the petitioners and their mother were informed of Sunjay Kapur's last will. They were told that the entire personal assets of their father have been bequeathed to Priya Kapur. On Friday, shares of Sona BLW Precision Forgings ended 0.6% lower at INR 407.10 on the National Stock Exchange.  End
