HC sends Ambuja Cements, JSW Cement to mediation in trademark case

NEW DELHI – The Delhi High Court on Wednesday referred Ambuja Cements Ltd. and JSW Cement Ltd. to mediation in a permanent injunction suit filed by the former against the latter. In the suit, Ambuja Cements argued that JSW Cement copied its "Kawach" brand in the latter's "Jal Kavach" cement.
The high court issued summons to JSW Cement and its arm JSW IP Holdings Pvt. Ltd. on Ambuja Cement's suit. The court would hear the matter next on Oct. 15 and continue with the hearing if mediation fails between the parties.
Ambuja Cements sought the court to restrain the defendants from using the name in its cement which was similar to the petitioner's. Ambuja Cements said that it owned the "Ambuja Kawach" trademark and has been using the same since 2020 in its water repellent cement.
The petitioner said that the respondents launched a competing product called JSW Cement CHD Jal Kavach and applied for its trademark registration in May. The petitioner sought the court to direct the removal of the respondents' trademark application.
The petitioner argued that the respondents' products and marketing were designed to mimic Ambuja Cements' branding. The use of similar descriptive terms such as "water resistance", "seepage prevention" and "durability" to capitalise on the established reputation of its "Kawach" product.
On Wednesday, shares of Ambuja Cements closed 1.5% higher at INR 582.05, and those of JSW Cement closed 0.6% lower at INR 147.77. End
