In relief to Delhi Intl Airport, HC junks waste mgmt tender on airport zone

NEW DELHI – In a relief to Delhi International Airport Ltd., the Delhi High Court has quashed the Municipal Corp. of Delhi's tender for setting up a material recovery facility for management of dry solid waste in Delhi's Najafgarh zone, to the extent that it includes the Aerocity area. The petitioner Delhi International Airport is a joint venture, formed as a consortium between GMR Airports Ltd., Airports Authority of India, and Fraport AG Frankfurt Airport Services Worldwide.
The court said that Delhi International Airport is carrying out the function of solid waste management at the airport site under Rule 4(7) of the Solid Waste Management Rules, 2016, read with the operation management and development agreement, executed between the Airports Authority and the petitioner company. In the absence of a specific provision under the Delhi Municipal Corporation Act, 1957, vesting this function and obligation exclusively in the civic body, it is legally impermissible for the corporation to include any part of the airport site, including Aerocity, in its tender for solid waste management, said the court. If the Municipal Corp. of Delhi's plea is accepted, the purpose of framing Rule 4(7) of the 2016 Rules would be defeated, the court said.
Delhi International Airport had said that it was established for the sole purpose of exercising rights and authority as well as carrying out obligations to undertake operations, maintenance, development, design, construction, upgradation, modernisation, finance, and management of Delhi airport, including solid waste management. Despite being aware of this, the municipal corporation had issued the tender purely for commercial reasons, Delhi International Airport said.
