HC seeks Sunjay Kapur's asset detail on former wife Karisma Kapoor kids plea

NEW DELHI – The Delhi High Court on Wednesday asked late Sunjay Kapur's third wife Priya Kapur to file a list of all movable and immovable assets of the deceased known to her as of Jun. 12, on his second wife actress Karishma Kapoor's children plea seeking a share in their father's assets, which are estimated at INR 300 billion. The high court issued notices to Priya Kapur and other defendants on Karishma Kapoor's children Samaira Kapur and Kiaan Raj Kapur plea.
The court registered Samaira Kapur and Kiaan Raj Kapur's plaint as a suit. The high court will hear the case next on Oct. 9 for considering the petitioners' plea for ad-interim injunction against Priya Kapur.
Advocate Mahesh Jethmalani, appearing for the petitioners, argued that the will by Sunjay Kapur was not registered. The father was meticulous in securing the properties of the children and it was surprising that the petitioners were left out from the will, said Jethmalani. "All this crying and weeping that is going on, just six days before the suit, the plaintiffs received INR 19 billion from the (RK Family) trust," said advocate Rajiv Nayar, appearing for Priya Kapur. Advocate Vaibhav Gaggar, appearing for Sunjay Kapur's mother Rani Kapur, said that her client was 80-yrs of age and she had received nothing while her children got money from the trust and the third wife got assets from the will.
The petitioners have sought a declaration that being class I legal heir they are entitled to their respective share in the personal assets and effects of their father in accordance with applicable inheritance laws. The petitioners have urged the court to pass a preliminary decree for a partition in their favour, saying they are entitled to and should each be given a fifth of their father's assets. They have also sought an order to appoint a local commission to effect the partition of assets.
Further, the petitioners have sought a decree of mandatory injunction directing Priya Kapur and other defendants to render full and complete records and accounts in relation to the late businessman's personal assets. They requested the court to pass a decree of permanent injunction restraining the defendants from alienating, transferring, selling, or in any manner creating third-party interests in any of the personal assets of their father.
In June, Kapur, who was chairman of auto parts company Sona BLW Precision Forgings Ltd., died unexpectedly while playing polo in the UK with initial reports citing cardiac arrest as the cause. His death triggered a bitter power struggle within the Kapur family over control and inheritance of the Sona Group empire. Kapur's father was a pioneer of India's auto components industry and had founded the group.
Karishma Kapoor and Sunjay Kapur had got married in 2003. The marriage was dissolved by mutual consent in 2016. Thereafter, in 2017, Sunjay Kapur married Priya Kapur. They have a son, Azarius S. Kapur.
In July, the petitioners and their mother were informed of Sunjay Kapur's last will. They were told that the entire personal assets of their father have been bequeathed to Priya Kapur.
At 1149 IST, the shares of Sona BLW Precision Forgings were 1.7% higher at INR 452.95 on the National Stock Exchange. End
