HC directs registrar to remove 'Roger' trademark on plea by Allied Blenders

NEW DELHI – The Delhi High Court has directed the trademarks registry to remove the "Roger" trademark of Kulbir Singh, director of Roger Industries Ltd., which is similar to Allied Blenders and Distillers Ltd.'s "Jolly Roger" trademark. "...this court has no qualms that there is a likelihood of injury or damage to the petitioner if the impugned mark is not removed from the register," the high court said.

 

The court noted that Allied Blenders has continuously and extensively used the "Jolly Roger" trademark since 2010 and acquired significant goodwill and reputation for its product. On the other hand, Singh had never used his "Roger" trademark.

 

Allied Blenders owns and operates a well-established business of manufacturing and marketing Indian-made foreign liquor and other related goods. The petitioner's merchandise is sold globally under many distinctive trademarks and caters to various consumer segments. 

 

The company said it has been using the "Jolly Roger" trademark since 2010 and selling goods under this name around the country. It said the trademark had acquired significant goodwill and reputation in the alcoholic beverages market in India. It further said it was going through immense hardship on account of the trademark body registering Singh's "Roger" trademark.

 

Friday, shares of Allied Blenders and Distillers ended 0.8% higher at INR 505.40 on the National Stock Exchange.  End
