SC notice to Centre, states on PIL seeking shops to display owners' details

NEW DELHI – The Supreme Court Monday issued notices to the Centre and all states in response to a public interest litigation seeking mandatory disclosure of details related to distributors, dealers, traders, sellers, and shop owners. The petition aims to strengthen consumer rights under the Consumer Protection Act, 2019, by enabling redressal against unfair trade practices and exploitation. The top court listed petitioner Ashwini Kumar Upadhyay's plea for hearing on Aug. 26.
The petitioner, a practising advocate, has urged the top court to direct both central and state governments to ensure all shop owners publicly display their registration details--including name, address, contact number, and number of employees--on a clearly visible board at the store's entrance. He argued that consumers have a right to know not only about the quality, quantity, potency, purity, standard, manufacturing date, expiry date, and various certification of good and products but also about the details of the shop owner so as to seek remedy against unfair trade practices.
The petition said the 'Right to Know' about distributor, dealer, trader, seller, and shop owner was secured under the Consumer Protection Act, and that access to such information is crucial to prevent fraudulent practices. This would help consumers to avoid falling prey to fraudulent or deceptive distributors, shop owners, who might misrepresent their product services or disappear after sale, purchase, and money transaction, said Upadhyay. Owner details are essential for filing complaints under Consumer Protection Act and seeking remedy through consumer redressal forums, the petitioner added. End
