HC asks Amazon, Flipkart to remove pdts infringing Reliance, Jio trademarks

NEW DELHI – The Delhi High Court has asked electronic commerce platforms Amazon.com Inc. and Flipkart Internet Pvt. Ltd. to take down fast-moving consumer goods that are infringing Reliance Industries Ltd.'s 'Reliance' and 'Jio' trademarks. The high court also restrained Pawan Kumar Gupta and others from selling and manufacturing any fast-moving consumer goods under the Reliance and Jio trademarks. Issuing notice to the respondents, the high court listed the case for hearing on Nov. 13.
It is prima facie evident that the defendants are using the marks of Reliance Industries and are guilty of imitating the trademarks, the high court said. The overall presentation of the defendants' goods was such that it was likely to confuse, the court said.
It is also a matter of fact that the defendants are dealing in the same line of business, and that they are operating through the same business channel and that they are also targeting the same set of customers as Reliance Industries, the high court said. The defendants want to ride on the goodwill and reputation attached to Reliance Industries' trademarks, the high court said.
The high court said the products of the defendants were sold through online e-commerce platforms where consumers rely on brand names and logos to identify the origin of goods. In such circumstances, if any confusion is allowed to continue, it could risk consumer safety. Therefore, in such circumstances, the court has to adopt a more cautious and stringent approach for judging the likelihood of confusion and to exercise greater care, Justice Saurabh Banerjee said.
The high court was hearing a permanent injunction suit by Reliance Industries against Gupta and others. Reliance Industries had adopted the Reliance and Jio trademarks in the 1960s and 2011, respectively. Reliance Industries came to know in June that Gupta and other parties were selling fast-moving consumer goods, including poha, wheat flour, foxnuts, pulses, lentils, salt and other products under the Reliance and Jio trademarks.
On Tuesday, shares of Reliance Industries ended 0.1% higher at INR 1,485.40 on the National Stock Exchange. End
