Bombay HC sets aside INR 1.24-bln GST demand order against Niva Bupa

NEW DELHI – The Bombay High Court has set aside a goods and services tax demand order of INR 1.24 billion against Niva Bupa Health Insurance Co. Ltd., the company said in an exchange filing. The high court has returned the matter back to the adjudicating authority for deciding the case afresh, according to the filing.

 

In 2023, the Directorate General of GST Intelligence, Pune Zonal Unit, had issued a show cause cum demand notice to Niva Bupa Health Insurance. In the notice, the tax department had alleged contravention of the provisions of the Central Goods and Services Tax Act, 2017 through non-payment of GST on the co-insurance premium and the reinsurance commission from July 2017 to March 2022.

 

Niva Bupa Health Insurance had filed its response to the show cause notice before the Additional Commissioner of Central Tax. However, the Principal Commissioner CGST and Central Excise pronounced its order and confirmed the alleged demand of INR 1.24 billion. Consequently, Niva Bupa Health Insurance filed a writ petition before the high court.

 

At 1158 IST, shares of Niva Bupa Health Insurance were up 1.7% at INR 83.36 on the National Stock Exchange.  End
