HC allows Nilkamal JV to sell induction cooktops under 'Stella' brand name

NEW DELHI – Vacating a 2024 interim injunction order, the Delhi High Court has allowed Cambro-Nilkamal Pvt. Ltd., a joint venture of Nilkamal Ltd., to sell induction cooktops under the brand name Stella, Stelladexin and other similar names. In 2024, the high court had passed an interim injunction order in favour of Products and Ideas (India) Pvt. Ltd., restraining the joint venture company from selling induction cooktops under Stella name.
The balance of convenience is in favour of the defendants as grant of an interim injunction would prevent the defendants from using the Stella marks, which have been used by the Stella Industrial Co. Ltd., a Chinese company, in India since 2013, said the high court. On the other hand, grant of interim injunction would create the monopoly in favour of Products and Ideas which only imports the goods bearing the Stella Marks from Stella Industrial, said the high court.
The court observed that just like Products and Ideas, the Nilkamal joint venture was also importing goods from the Chinese company, through the authorised distributors of the Chinese company and selling the same in India. The goods sold by the joint venture were genuine and original products of the Chinese company, imported and resold with full authorisation from Stella Industrial, said the court.
Products and Ideas, a company dealing in commercial kitchen and bakery equipment in India, was selling commercial induction cooktops under the brand name Stelladexin. The Stelladexin mark was adopted by Stella Industrial Co, which had allowed Products and Ideas to use the brand name and authorised it to register the said trademark.
Products and Ideas and Stella Industrial had entered into an exclusive agency agreement in 2017, wherein the former was appointed as the exclusive agent for the distribution, sale and promotion of induction cookers under the brand Stella. Stella Industrial was an original equipment manufacturer and was supplying goods to Products and Ideas through its local partners under the agreement.
In 2024, it came to the knowledge of Products and Ideas that Cambro-Nilkamal and its distributors were selling the induction cooktops under the brand name Stella which was similar to the plaintiff's registered trademark. Aggrieved by the aforesaid, Products and Ideas filed a suit seeking relief of permanent injunction along with other ancillary reliefs, which was still pending in the court.
At 1315 IST, shares of Nilkamal Ltd. were up 0.5% at INR 1,792.70 on the National Stock Exchange. End
